Payment Policies
To secure the booking, a partial payment of $250.00, is due within 10 days of guest confirmation of intention to book
Payment [plus a refundable damage deposit of $250.00] must be fully settled: 60 days prior to arrival, or if that date is already passed, then within 10 days of guest confirmation of intention to book.
If cancellation is necessary it is required 60 days or more prior to scheduled arrival date in value season, and 90 days or more prior to scheduled arrival date in high/peak season. An administration fee of $100.00 will be charged.
If cancellations are made less than the 60/90 days prior to scheduled arrival or after scheduled arrival date, payments will be retained. If the unit can be re-rented, a pro-rata refund will be issued less the administration fee of $100.00.
Security/Damage deposit is refunded within 30 days after departure and checkout inspection if no damage or missing items.

Total number of occupants will not exceed the quoted number unless agreed.
1. CHECK-IN TIME IS AFTER 3 P.M. AND CHECK-OUT IS 10 A.M. NO Early Check-in or late check-out.
2. This is a NON SMOKING unit.
3. Pets are not permitted in rental units under any conditions.
4. DAMAGE/RESERVATION DEPOSIT- A damage/reservation deposit of $250 ($500.00 for 3 weeks or
longer) is required. This must be received within seven (10) days of booking the reservation. The deposit
automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent;
however, it is fully refundable within (30) days of departure, provided the following provisions are met.
a. No damage is done to condo or its contents, beyond normal wear and tear.
b. No charges are incurred due to contraband, pets or collection of rents or services rendered during the
stay.
c. All debris, rubbish and discards are placed in dumpster, and soiled dishes are placed in the
dishwasher or cleaned. One load of laundry/towels to be started. There will be a charge of
$25.00 if all trash is not taken out, a $25.00 charge if dirty dishes are left out, a $25.00
charge if a load of towels is not started, and a $25.00 charge if décor is moved/rearranged
and not put back in place upon departure.
d. All keys are left on the kitchen and all doors and windows are left locked.
e. A/C, ceiling fans and lights are turned off and safe is left open unlocked.
f. No items are lost or damaged.
g. Beach items are wiped down and free from sand.
h. NO Early check-in or late check-out without prior agreement.
i. The renter is not evicted by the owner (or representative of the owner), the local law enforcement, the
security company employed by Maui Kamaole Resort.
5. PAYMENT – Full payment is required (60) days before arrival in Value Season and High Season and 90
before in Peak Season. Please make payments in the form of traveler's checks, bank money orders,
cashiers checks or personal checks payable to Jodi Orosz. If payment is from outside the US money
orders or cashiers checks need to be drawn on a US Bank.
6. CANCELLATIONS – If cancellation is necessary it is required (60) days or more prior to scheduled
arrival date in value season, and 90 days or more prior to scheduled arrival date in high/peak season an
administration fee of $100.00 will be charged. If cancellations are made less than the 60/90 days prior to
scheduled arrival or after scheduled arrival date, payments will be retained. If the unit can be re-rented, a
pro-rata refund will be issued less the administration fee of $100.00. Cancellation or early departure does
not warrant any refund of rent or deposit.
7. Refund Policy – Agent(s) cannot guarantee against mechanical failure of air conditioning, Hot Tubs,
TVs, Cable service, VCRs, or other appliances. Please report any inoperative equipment to us or our onisland
agent immediately. We will make every reasonable effort to have repairs done quickly and
efficiently. No refunds or rent reductions will be made due to failure of appliances or equipment. No
refunds for early departures (fewer days than reserved) ~ No refunds will be given for delayed
arrival ~ No refunds for reducing the number of nights reserved.
8. Acts of God – Neither Owner nor on-Island Agent shall be liable for events beyond their control which
may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental
agencies, fire, strikes, war, or inclement weather. NO REBATE OR REFUND will be offered in these
circumstances
9. MAXIMUM OCCUPANCY- The maximum number of guests is limited (4) persons including infants (Each
child counts as one guest). An additional $10.00 per person per night will be charge for guests in addition
to the total number advised by guest in this agreement. More than the allowed amount of guest is cause
for eviction.
10. MINIMUM STAYS- Longer minimum stays may be required during Holiday periods. IE: 14 days during
Christmas/New Years.
11. TAXES & FEES– A 14.42% tax will be charged for Hawaii State taxes and a one-time $35.00
reservation fee.
12. MAID SERVICE – While linens and bath towels are included in the condo, daily maid service is not
included in the rental rate but may be available at an additional cost. We provide beach towels however;
other towels or linens are not permitted to be taken from the condo. A check out cleaning of $105.00 is
charged.
13. Vacation Rental Insurance – It is recommended that Guest purchase Vacation Rental Insurance to
cover Booking and any other costs, such as airfare, related to its occupancy.
14. Indemnification and Hold Harmless – Guest(s) agree to indemnify and hold harmless the Owner and Agent for any liabilities,
theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection
with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage
or theft of property which is made, incurred or sustained by Guest(s).
15. Listings and Pricing – Information regarding individual listings is believed accurate but cannot be guaranteed. We have made
every effort to ensure that all the information on Agent‘s website(s) is current and accurate. Rates, furnishings, fees, and taxes are
subject to change without notice.
16. Pest Control – Many different pests live and thrive in this region. Your unit has been professionally
treated by a commercial pest control company with precise and complete preventative treatments in an
effort to keep all the pests and bugs outside. Should you experience a pest control issue, please contact
the owner or on island to attempt to eradicate the problem.
17. CONSTRUCTION- We cannot predict construction in the area and therefore can not be responsible for
any construction that may be occurring near one of our vacation rental condo.
18. RATE CHANGES – Rates subject to change without notice.
19. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to
forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to checkin.
20. WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing
in advance.
21. PARKING PASSES – Parking passes are issued at the Maui Kamaole front desk located at the lower
pool area between 8:00am to 4:00pm. If arriving after these hours please obtain a parking pass the next
morning. A parking pass must be displayed on the rear view mirror at all times. Failure to display may
result in towing of vehicle at renter's expense.
22. HURRICANE OR STORM POLICY – No refunds will be given unless:
a. The National Weather Service orders mandatory evacuations in a "Tropical Storm/Hurricane Warning
area" and/or
b. A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of
residence of a vacationing guest. The day that the National Weather Service orders a mandatory
evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
1. Any unused portion of rent from a guest currently registered,
2. Any un used portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to
come in after the Hurricane Warning is lifted.
3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the
"Hurricane Warning" period.
I agree that all rental monies are non-refundable per cancellation policy above. I have read my rights to
purchase travel insurance. By Signing Below, I agree to all terms and conditions of this agreement.
